Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the ArkFlow website and platform, operated by Solarmente (Pty) Ltd, trading as ArkFlow. By creating an account or using the platform, you agree to these Terms. If you do not agree, do not use the platform.

ArkFlow provides an operating system for solar EPCs and installers: lead capture and pipeline, indicative finance proposals, a guided client finance application that packages deals for funders, site inspection, an engineering design studio, yield simulation, a project document register and milestone invoicing. The owner account, field seats, the pipeline, proposals, the client finance application and the handover pack are available free of charge. Additional user seats and the Engineering Studio are paid features.

ArkFlow is intended for businesses — solar and water installers and EPCs, suppliers, brokers, and funders. You are responsible for the accuracy of the information you provide, for keeping your login credentials secure, and for all activity under your account.

• The owner account is free of charge and does not expire. No card is required. Engineering Studio use on the free owner account is limited to two engineering projects per calendar month.
• Field and site-capture seats are free of charge and unlimited.
• Additional sales seats and Engineering Studio seats are billed per user per month, in ZAR excluding VAT, via PayFast. Current prices are published at arkflow.co.za/pricing.
• Where a deal is funded through a lender introduced by ArkFlow, a platform fee of 1% of project capex applies. It is included as a stated line in the bill of quantities submitted to the lender, funded at drawdown, and invoiced pro-rata as each payment is released. No platform fee applies where you fund a deal through your own lenders.
• Each seat may be registered to a maximum of two devices.
• Subscriptions renew monthly until cancelled. You may cancel at any time, effective at the end of the current billing period. Cancelling paid seats does not close your free owner account.
• Fees already paid for the current period are non-refundable except where required by law.

Finance proposals, calculators and figures produced by ArkFlow (including the on-site calculator) are indicative estimates for planning purposes only. They are not a credit agreement, a binding finance offer, a quote, or financial advice. Actual finance terms are determined solely by the relevant lender or funder, subject to their assessment, credit approval and the National Credit Act where applicable.

You agree not to:

• Use the platform for any unlawful purpose or to submit fraudulent or misleading information.
• Upload another party’s personal or financial information without a lawful basis and their awareness.
• Attempt to disrupt, reverse-engineer, or gain unauthorised access to the platform.
• Resell or sublicense access to the platform except as expressly permitted.

You retain ownership of the client and deal data you put into ArkFlow. You grant us the limited right to process it to deliver the service. Where you use the white-label features, you are responsible for the accuracy of your branding and for your relationship with your end clients. Our handling of personal information is described in our Privacy Policy.

ArkFlow facilitates the packaging and submission of finance applications to banks and funders. We are not a lender. The decision to fund, the finance terms, and the relationship with the funder rest between the client and the funder. ArkFlow is not responsible for any funder's decision, conduct, or terms.

The ArkFlow platform, software, brand and content are owned by Solarmente (Pty) Ltd. These Terms do not transfer any intellectual property rights to you beyond the limited right to use the platform.

The platform is provided “as is”. To the maximum extent permitted by law, ArkFlow is not liable for indirect or consequential loss, or for loss arising from funder decisions, third-party services, or your reliance on indicative figures. Nothing in these Terms excludes liability that cannot lawfully be excluded.

You may stop using ArkFlow and close your account at any time. We may suspend or terminate access where these Terms are breached or where required by law. Provisions that by their nature should survive termination will do so.

These Terms are governed by the laws of the Republic of South Africa, and the South African courts have jurisdiction over any dispute.
